Free Legal Assistance Centers

FLACs are open to provide legal consultations to all those who wish, as well as to increase the level of legal protection for vulnerable populations, to provide access to justice, and to assist in the realization of rights, freedoms and legitimate interests of citizens. In such centers, visitors can receive consultations of highly qualified lawyers, public notary officers, as well as defense attorneys, who are entitled and included into the system of state guaranteed legal aid.

About the Center for the Coordination of State-guaranteed Legal Aid at the Ministry of Justice of the Kyrgyz Republic

1. General Provisions

1. The Center for the Coordination of State-Guaranteed Legal Aid under the Ministry of Justice of the Kyrgyz Republic (hereinafter - the Center) was established in accordance with the Law of the Kyrgyz Republic "On State-Guaranteed Legal Aid", and is a subordinate unit of the Ministry of Justice of the Kyrgyz Republic (hereinafter the Ministry).

2. In its activities, the Center is guided by the Constitution of the Kyrgyz Republic, the Law of the Kyrgyz Republic “On State-Guaranteed Legal Aid”, laws of the Kyrgyz Republic, decrees of the President of the Kyrgyz Republic, resolutions of the Government of the Kyrgyz Republic and other normative legal acts of the Kyrgyz Republic, decisions of the Ministry order by virtue of international treaties to which the Kyrgyz Republic is a party, as well as this Regulation .

3. The Center is an independent legal entity operating in organizational and legal form - an institution, it has a seal with the image of the State Emblem of the Kyrgyz Republic and its name in the state and official languages, an independent account in banking institutions.

4. The center is independent in the implementation of the functions assigned to its competence. Control over the activities of the Center is carried out by the Ministry.

5. The results of the Center’s activities are discussed at the board of the Ministry. Reports on the work of the Center are published on the official website of the Ministry.

2. The purpose and objectives of the Center

7. The center was established to coordinate the process of providing state-guaranteed legal assistance and on interaction between government bodies, local governments, the Bar of the Kyrgyz Republic and civil society institutions.

8. The tasks of the Centers are:

1) implementation of the state policy of the Kyrgyz Republic in the provision of state-guaranteed legal assistance;

2) promoting the development of a system of state-guaranteed legal aid;

3) a summary of the practice of providing qualified legal assistance in the implementation of the Law of the Kyrgyz Republic "On State-guaranteed Legal Aid";

4) assistance in the protection of the rights, freedoms and legitimate interests of persons in need of state-guaranteed legal assistance;

5) interaction with state bodies, local self-government bodies, the Bar of the Kyrgyz Republic, other organizations and persons regarding the provision of state-guaranteed legal aid;

6) assistance in legal education of the population, development of legal culture and legal awareness of citizens together with government bodies, local governments, the Bar of the Kyrgyz Republic and other institutions of civil society.

3. Functions of the Center

9. In accordance with the assigned tasks, the Center performs the following functions:

1) assists in the provision of qualified legal assistance to citizens in need of the Kyrgyz Republic, foreign citizens, stateless persons and refugees;

2) appoints lawyers in accordance with received requests;

3) concludes with lawyers participating in the system of provision of state-guaranteed legal aid agreements on the provision of qualified legal aid;

4) sends lists of lawyers participating in the system of provision of state-guaranteed legal assistance to the judicial authorities, prosecutors, law enforcement agencies, the Bar of the Kyrgyz Republic;

5) evaluates the quality of qualified legal assistance provided by lawyers by monitoring, requesting and verifying information from coordinators and lawyers with the provision of documents specified in the contract concluded between the Center and a lawyer, questionnaires of legal aid recipients, etc .;

6) pay a lawyer for the provision of qualified legal assistance;

7) monitors the reasonableness of the payment made to the lawyer;

8) considers complaints from beneficiaries regarding qualified legal assistance provided by a lawyer;

9) in the event of a complaint against a lawyer about his violation of the rules of professional ethics, refer the complaint to the Bar of the Kyrgyz Republic;

10) compiles quarterly and annual analytical reports on the provision of qualified legal assistance and submits them to the collegium of the Ministry, the Minister of Justice of the Kyrgyz Republic for review by the Government of the Kyrgyz Republic and publishes it on the Ministry’s website;

11) develops proposals for financing the provision of qualified legal assistance;

12) develops and submits to the Ministry quarterly reports on the use of funds allocated for the provision of qualified personnel
